Risk Profile Terms & Conditions Sharenet Wealth (Pty) Ltd - FSP 41688
- The Test FinaMetrica provides a psychometric risk-tolerance questionnaire, scoring and report ("the Test"). It measures only risk tolerance. It does not assess risk capacity or risk required, and it is not financial advice under the FAIS Act.
- Parties The Test is offered on www.sharenet.co.za under licence from FinaMetrica to Sharenet Wealth (Pty) Ltd (FSP 41688), an authorised financial services provider. The two companies are independent.
- Licence You receive a personal, non-exclusive, non-transferable licence to use the Test for your own purposes only. All intellectual property remains with FinaMetrica. You may not reverse-engineer, copy, modify or distribute the Test.
- Not Advice (FAIS) The Test and report do not constitute advice under the FAIS Act. They are not a recommendation or proposal regarding any financial product. Any advice based on the results must still be given by an authorised representative after a full suitability analysis (needs, objectives, financial situation, risk capacity, risk required, knowledge and experience).
- Liability To the maximum extent permitted by South African law (including the FAIS Act, CPA and POPIA):
- We exclude liability for indirect or consequential loss.
- Our total liability is limited to the fee paid for the Test in the preceding 12 months (or the cost of re-supply if no fee was paid).
Nothing in these terms excludes liability for death or personal injury caused by negligence, gross negligence, fraud, or any other liability that cannot lawfully be excluded.
- Privacy (POPIA) By accepting these terms you consent to Sharenet Wealth processing your questionnaire answers, demographic data and contact details to provide the Test, generate the report and send related notices. Only anonymised data is shared with FinaMetrica for research. You retain all rights under POPIA (access, correction, deletion, objection and complaint to the Information Regulator). - Complaints Contact us first at wealth@sharenet.co.za. If unresolved and the complaint concerns a financial service, you may refer it to the FAIS Ombud (www.faisombud.co.za). Privacy complaints may be referred to the Information Regulator.
- Governing Law These terms are governed by the laws of the Republic of South Africa. South African courts (preferably the Western Cape High Court) have exclusive jurisdiction.
- Acceptance Clicking "Accept" creates a binding electronic agreement under the Electronic Communications and Transactions Act.
