It was also explained that in the event that the matter proceeds, and if there is an adverse finding regarding all these alleged transgressions, insofar as the financial exposure in terms of a fine is concerned, the maximum fine payable is up to R15m in terms of the legislation. Shareholders are hereby notified that the summons instituting criminal proceedings in this regard was served on the Company on 30 May 2019. There are three charges, two of which relate to the alleged conduct of certain activities without an AEL and one relating to the alleged failure to adhere to the AEL by exceeding certain minimum emission standards. The Company has obtained legal advice from Senior Counsel regarding these matters and will now adhere to the relevant legal processes that will follow.
