WITHDRAWAL OF THE EXEMPTION ON ANNUAL REPORTING OF IRREGULAR, FRUITLESS
AND WASTEFUL EXPENSES

Further to the announcement released on SENS on 4 April 2023, noteholders are advised that
on 9 June 2023, Eskom received notice of the withdrawal of the partial exemption from
certain sections of the Public Finance Management Act (PFMA) and Treasury Regulations from
National Treasury (the “Exemption”).

The decision to withdraw the Exemption means that Eskom will continue to disclose financial
and non-financial information on irregular, fruitless and wasteful expenditure and material
losses from criminal conduct as per National Treasury instructions.

Compliance to the PFMA and all applicable legislation remains a priority as Eskom continues
to address irregular, fruitless and wasteful expenditure, and Eskom will continuously
implement measures to address all the issues that continue to have a negative impact on the
company’s financial sustainability.
