REAPPOINTMENT OF UMGENI WATER BOARD

Further to the statement by the Minister of Water and Sanitation released on SENS on 28 October 2021, Umgeni Water
has received confirmation that the Honourable Senzo Mchunu, MP supported by the Cabinet, has reconfirmed the
appointment of the Board of Umgeni Water. This decision is in strict compliance with due process as dictated by
Schedule 1 to the Water Services Act 108 of 1997 (the “Act”), read with section 35 of the Act. The appointment of
Board Members of all Water Boards is a legislative prerogative of the Minister of Water and Sanitation.

Following the disbanding of the Board of Umgeni Water by the former Minister of Human Settlements, Water and
Sanitation, Ms Lindiwe Sisulu, MP, an Interim Board was appointed to replace it. The Interim Board served from August
2020 to 25th October 2021. The disbanded Board was appointed by the then-outgoing Minister of Water and Sanitation,
Mr Gugile Nkwinti, MP, and had occurred in accordance with the Water Services Act, No.108 of 1997.

As is known, the decision to disband the Board was the subject of a legal challenge in the KwaZulu-Natal High Court,
Pietermaritzburg. The High Court has since ruled in its judgment that the decision to disband the Board and appoint
an Interim Board were unlawful and set aside both decisions.

The former Board was disbanded on the basis that it was not endorsed by the National Government Cabinet. The
current Minister of Water and Sanitation, Mr Senzo Mchunu, MP, has since ratified the appointment of the former Board
through endorsement by the National Government Cabinet. It was announced in a statement from National Government
Cabinet on Thursday, 4th November 2021, that Cabinet has endorsed the re-appointment of the previous Board.

The Board has been re-appointed in order to strengthen governance within Umgeni Water.
The Board Members who have been re-appointed by the Minister of Water and Sanitation and endorsed by the Cabinet
on Wednesday, 3rd November 2021, are listed below:
