Appeal against directive by Department of Environmental Affairs Interwaste Holdings Limited (Incorporated in the Republic of South Africa) (Registration number 2006/037223/06) JSE code: IWE ISIN: ZAE000097903 (“the Company”) APPEAL AGAINST DIRECTIVE BY DEPARTMENT OF ENVIRONMENTAL AFFAIRS Shareholders are referred to the announcement, released on the Stock Exchange News Service on 17 February 2017, regarding the Department of Environmental Affairs (“DEA”) directive against FG Landfill, and Interwaste (Pty) Ltd’s (“Interwaste”) appeal against same. Subsequent to an urgent application by Interwaste on 17 February 2017, the High Court issued an order suspending the directive and confirming that operations on site may continue, pending further legal argument on the appeal and the directive. The matter is expected to be before court again on 23 February 2017, or so soon thereafter as possible. FG Landfill site remains open at this time. In a media release by the DEA on 16 February 2017, the impression was created that Interwaste has failed to implement certain commitments made regarding the site. This is incorrect. All applicable operational and infrastructure improvements at the site have been implemented. Furthermore, critical commitments made have been completed. For example, extensive surface and ground water sampling within a 1.5 kilometer radius of the site has confirmed that the site has no impact on water resources. Other commitments, limited to scientific studies (and not the implementation of specific operational measures) are either in progress or have become superfluous based on subsequent monitoring. For example, air quality studies have confirmed that no significant health impacts exist due to operations on site.
