Proclamation relating to Umgeni Water
The President of the Republic of South Africa has issued a Proclamation no 4 of 2019 dated 1
February 2019 (Government Gazette 42204) for the investigation of allegations made in respect of
the affairs of Umgeni Water. In this regard, the following matters have been referred for
investigation to the Special Investigating Unit:
1. serious maladministration in connection with the affairs of Umgeni Water;
2. improper and unlawful conduct by board members, officials and employees of Umgeni Water;
3. unlawful appropriation or expenditure of public money or property;
4. unlawful, irregular or unapproved acquisitive acts having bearing upon State property;
5. intentional or negligent loss of public money or damage to public property;
6. offences under Chapter 2 of the Prevention and Combating of Corrupt Activities Act, 2004
which were committed in connection with the affairs of Umgeni Water; and
7. unlawful or improper conduct by any person which has caused or may cause serious harm to
the interests of the public.

In this regard Umgeni Water welcomes the Presidential Proclamation and assures
stakeholders that the SIU will receive full co-operation from Umgeni Water. The SIU will
receive the required support to enable them to conduct their work without hindrance and
also bring to finality matters under scrutiny. Notwithstanding the allegations as reflected in
the Presidential Proclamation, Umgeni Water assures its stakeholders that the entity
remains stable, resilient, properly governed and continuously improves its internal
processes to align to best practices and remains committed to full legal compliance. The
entity’s financial and non-financial performance continues to improve, ensuring that the
entity’s ability to execute its mandate brings confidence to all its stakeholders.
