Appeal against directive by Department of Environmental Affairs Interwaste Holdings Limited (Incorporated in the Republic of South Africa) (Registration number 2006/037223/06) JSE code: IWE ISIN: ZAE000097903 (“the Company”) APPEAL AGAINST DIRECTIVE BY DEPARTMENT OF ENVIRONMENTAL AFFAIRS Shareholders are advised that the Department of Environmental Affairs (“DEA”) has served a directive on Inter-Waste (Pty) Ltd (“Interwaste”), the main operating subsidiary of the Company, requiring the cessation of waste disposal facilities at the FG Landfill with effect from 18 February 2017. The DEA has issued the directive based on complaints from the community regarding air pollution allegedly emanating from the landfill. Interwaste has commissioned a number of scientific studies on emissions from the landfill, most of which were conducted by independent third parties. The results of those studies refute the allegations of air pollution. Interwaste has therefore appealed against the directive to the Minister of Environmental Affairs which appeal, according to independent legal advice, suspends the operation of the directive. Based on the advice it has received, Interwaste is confident that the matter will be resolved in its favour in due course and that the landfill will continue operating for the foreseeable future. However, Interwaste has alternative waste disposal facilities available, including the newly constructed Klinkerstene Landfill, and has access to third party facilities, in the event that it is required to divert waste streams from the FG Landfill site.
