The business rescue practitioners (“BRPs”) appointed in respect of Ububele and the Ububele Subsidiaries intend to launch another application in the High Court of South Africa (Western Cape Division, Cape Town) for an order extending the time periods prescribed for the publication of a business rescue plan in terms of section 150(5) of the Companies Act 71 of 2008 (“the Act”). The BRPs will also apply for an extension to the three-month time limit for business rescue proceedings as contemplated by section 132(3) of the Act. The application will be filed on 21 October 2014 and will be set down for hearing on 23 October 2014.
