Court order On 29 July 2014 Juanito Damons (‘the applicant’), the Business Rescue Practitioner of Holdings, filed a notice of motion against Holdings (‘the respondent’). In the notice the applicant applied to the High Court as a matter of urgency to be heard on Tuesday 5 August 2014, for an Order in the following terms: 1. That this application be heard on an urgent basis and that the failure to comply with the normal time periods, manners of service and enrolment be condoned in terms of Unifom Rule 6(12); 2. The respondent’s business rescue is herewith discontinued and the respondent placed in final liquidation. 3. The applicant’s fees as business rescue practitioner shall form part of the administration costs of the respondent in liquidation. 4. The costs of this application shall form part of the administration costs of the Respondent in liquidation. 5. Further and/or alternative relief.
