UPDATE TO SHAREHOLDERS
Shareholders are referred to the SENS announcement dated 9 April 2013 regarding the second provisional
liquidation application against Angel Diamonds (Pty) Ltd (“Angel Diamonds”) (Case Number
CIV/PET/01/2011) (“the Second Liquidation Case”).
The appeal (Case Numbers C OF A 36 & 37/2012) against the dismissal of the Second Liquidation Case on
1 November 2012, was upheld on 19 April 2013 with costs. Thabex and others can now commence with
damages claims against the Minister of Natural Resources and others.
Shareholders are also referred to the SENS announcements, dated 14 September 2012 and 18 March 2013,
relating to the two interdicts against the Minister of Natural Resources and others (Case Number
CIV/APN/664/2010). On 17 April 2013 the two interdicts were discharged and costs reserved in the High
Court of Lesotho. Thabex and others are still considering the option of an appeal after obtaining the
necessary legal advice in this regard. As things stand it is not clear as to which case the Judge has made an
order to reserve costs.
Shareholders will be advised of future developments.
