UPDATE TO SHAREHOLDERS
Shareholders are referred to the SENS announcement dated 8 February 2013 referring to the second
provisional liquidation application against Angel Diamonds (Pty) Ltd (“Angel Diamonds”) (Case Number
CIV/PET/01/2011) (“the Second Liquidation Case”).
The appeal (Case Numbers C OF A 36 & 37/2012) against the dismissal of the Second Liquidation Case is
set down to be heard on 5 April 2013 in the Appeal Court of Lesotho. A security for costs application by
Thabex, Angel Diamonds and others against the Appellants in the Appeal Case is scheduled to be heard on
25 March 2013 in the Appeal Court.
The hearing in the interdicts (30 November 2010 and 30 September 2011) (“Interdict Cases”) against, inter
alia, the Minister of Natural Resources and others in Case Number CIV/APN/664/2010 was heard on 13
March 2013 and judgment is expected on 19 April 2013. During the hearing all the opposing affidavits,
supporting affidavits, formal notices and pleadings filed by Messrs Engelbrecht and Mosebo were dismissed,
in terms of an unopposed interlocutory dismissal application by Thabex and others in the Interdict Cases
dated 3 October 2012, as they have failed to provide security for costs for an amount of R250 000 as
ordered by the Honourable Court on 30 August 2012.
The hearing of the interdict in the High Court of Lesotho, in terms of Case Number CIV/APN/554/2012,
against Messrs Engelbrecht, Mosebo and others to prevent them from continuing to misrepresent the affairs
of Angel Diamonds has been set down for 2 May 2013.
The hearing of the alleged labour dispute brought by Mr Mosebo on 26 November 2012 against Angel
Diamonds was partially heard on 12 March 2013 and again postponed to 8 May 2013.
Shareholders will be advised of future developments.
