JUDGEMENT RESERVED IN SAFCOL / YORK MATTER

Judgement was reserved today in the High Court, Pretoria, in the proceedings between South African Forestry Company Limited (Safcol) and Yorkcor's main operating subsidiary, York Timbers Limited (York). Safcol is seeking a declaratory order that York's evergreen contracts, concluded in 1968 and 1970, were validly terminated in November 1998. The action is part of a series of litigation in the High Court as well as the Competition Tribunal some of which is still pending.
Pending also, is an application by York for a contempt order against the Minister and the Director General of Water Affairs and Forestry for failing to honour several orders of the High Court and Supreme Court of Appeal. That matter was postponed sine di e (without a date) after the late filing of papers by the Respondents. It will be set down for hearing as soon as pleadings have been closed.
